In New Jersey, a blood alcohol concentration (BAC) of .08% or higher is guilty of driving while intoxicated (DWI). A breathalyzer test may be used to determine a driver’s BAC. However, a breathalyzer test is not necessarily needed for a DWI conviction; a police officer’s observations may be enough. In New Jersey, a driver is required by law to submit to a breathalyzer. Refusal to submit to a breathalyzer may result in severe penalties, including a loss of driving privileges.
The State of New Jersey’s penalties for DWI are severe. For example, an individual’s first DWI conviction will result in a loss of license for a period of time ranging from three months to a year. Those found guilty of DWI also face a fine of up to $500 as well as possible imprisonment. Furthermore, New Jersey assesses a surcharge of $1,000 per year for three years.
Allegations of DWI arising out of the Township of Bloomfield are not uncommon. Bloomfield is located along the Garden State Parkway where thousands of drivers pass every day. Therefore, the Bloomfield Municipal Court regularly handles driving under the influence cases that arise out of the Township of Bloomfield. The Municipal Courthouse is located at the Municipal Plaza, 209 Montgomery Street. The Honorable John A. Paparazzo is the presiding Judge.
