SSD Lawyers Help Newark Resident Get the Benefits They Deserve

Newark is the largest city in New Jersey and is home to over 275,000 residents and 61,641 families. Of Newark’s residents, 22.4% over the age of 65 are living below the poverty line, many because they are unable to work due to disability. Dealing with a disability affecting an individual’s ability can be trying and frustrating on families, especially in today’s economic climate. However, Social Security Disability Insurance, commonly referred to as SSD or SSDI, can help alleviate the financial strains on a family caused by a disability that prevents one from working.

Social Security Disability Benefits

SSD is a program created by the Federal Government as an income supplement to those who are unable to work as a result of a physical or mental disability. Managed by the Social Security Administration and funded through payroll taxes, SSD can be granted on a temporary or permanent basis depending on whether your disability is temporary or permanent. Unlike Social Security Insurance, SDD is available regardless of your level of income and benefits can be paid to you or to members of your family.

In order to be eligible for SSD benefits, an applicant must meet the Social Security Administration’s standard for disability and have been employed for an adequate period of time. To determine whether an applicant is disabled the Social Security Administration will collect medical and other relevant information to decide whether an applicant meets Social Security’s definition of disabled. The relevant factors in this determination include whether:

  1. You cannot do the work that you did before.
  2. You cannot adjust to other work because of your medical condition.
  3. Your disability is expected to last at least one year or result in death.

SSD Application Process

During the application process the Social Security Administration will also determine whether an applicant has worked for a long enough period of time to be eligible for SSD benefits. To make this determination the Social Security Administration uses a credit system based on the amount of wages earned each year. The amount varies year to year, but generally an applicant must have a total of 40 credits, 20 of which have been earning in the last 10 years ending in the year the disability occurred. However, younger workers affected by a disability can be eligible for SSD with fewer credits.

The process for securing SSD can often be complicated and confusing, but you do not have to face it alone. An experienced attorney can assist you in navigating the application and appeal process and help your family achieve a level of economic assistance during a difficult time.
