In New Jersey, domestic violence offenses are taken seriously. Domestic violence cases are governed by the Prevention of Domestic Violence Act. Under the Prevention of Domestic Violence Act, the following persons are protected: any person 18 years of age or older or emancipated minor who has been subjected to domestic violence by a spouse, former spouse, or any other member of the household; or, any person, regardless of age, who has been subjected to domestic violence by a person with whom the victim has had a child in common or with whom the victim has had a dating relationship.

Domestic violence occurs when one or more of the following criminal offenses are committed against a person protected under the Prevention of Domestic Violence Act:

  • Terroristic threats N.J.S.A. § 2C:12-3
  • Kidnapping N.J.S.A. § 2C:13-1
  • Criminal Restraint N.J.S.A. § 2C:13-2
  • False imprisonment N.J.S.A. § 2C:13-3
  • Criminal mischief N.J.S.A. § 2C:17-3
  • Burglary N.J.S.A. § 2C:18-2
  • Criminal trespass N.J.S.A. § 2C:18-3
  • Harassment N.J.S.A. § 2C:33-4
  • Stalking N.J.S.A. § 2C:12-10

A temporary restraining order is given upon an accusation of domestic violence. Later, a hearing will be held to determine whether a permanent restraining order is appropriate. Restraining orders can have a detrimental effect on your life. For example, a restraining order may prevent you from seeing your children, restrict your ability to travel, and/or prohibit you from possessing any handguns.
