New Jersey DWI Law

In New Jersey, a blood alcohol concentration (BAC) of .08% or higher is guilty of driving while intoxicated (DWI). A breathalyzer test may be used to determine a driver's BAC. However, a breathalyzer test is not necessarily needed for a DWI conviction; a police officer's observations may be enough. In New Jersey, a driver is required by law to submit to a breathalyzer. Refusal to submit to a breathalyzer may result in severe penalties, including a loss of driving privileges.

The State of New Jersey's penalties for DWI are severe. For example, an individual's first DWI conviction will result in a loss of license for a period of time ranging from three months to a year. Those found guilty of DWI also face a fine of up to $500 as well as possible imprisonment. Furthermore, New Jersey assesses a surcharge of $1,000 per year for three years.
